Went to purchase a Charge 5 but it's out of stock

I have a charge 4 which broke under warranty, the connector from the device to the straps broke. So I contacted them, got a choice of either a replacement or 50% off an upgrade. I chose upgrade. So the problem is I went on the website, picked my charge 5, put the discount code in, paid the excess, and no where in this whole process does the site tell me they're out of stock. I got that nugget of information at the confirmation email AFTER they took my money!! 

I feel this is really dodgy, unethical and borderline illegal. They should tell you they don't have stock before you pay them. No idea what to do now. I put in a complaint but all I got was a lousy apology and they still have both my money and my device. 

I checked and this item is in stock at all Officeworks and JBHIFI stores in my city... should have gone to them instead...
