Any way to prove it has not bee in use?

I was conned by an @$$ who sold me a broken fitbit. I don't think he was aware it was broken, but he refuses to pay me the money back. He lives in my community and has a high reputation aswell, so he is pissed off, and I am pissed off. It was supposed to be a present for my sons birthday, and it was the only budget I had. (I am single mum on a minimum income).

 

I am now trying to figure out how to prove to him that it is in fact broken, and that I (or we) did not break it. I am now wondering if it is possible to look up any data in the watch, to show that it has not been in use? If so I plan to take it to the nearest shop which sells fitbits and ask if they can help me with that. It's just that said shop is almost two hours away, so I don't want to head out to that for a hit and miss.

I don't think it's possible to prove it hasn't been used. It would be possible to use the fitbit and then remove it from the account and it would appear as though it had not been used and there would be no accessible data on the fitbit to prove otherwise.

 

Are you sure it's broken? Is there anything we can help with in trying to get it working again and avoid this awkward situation?
