If you add to your account as though it were a new tracker then it will delete any data left on it and reassign it to your account. As long as his phone is out or bluetooth range then that should not be an issue.

And we also need to face the possibility of the fitbit being defective. If this is the case you won't be covered by a warranty given you got it from eBay
As @SteveH points out, as long as you are at least a couple hundred feet away from the old owner. Having it attached to his account is not a problem.
