Watch Face Rejected - Copyright??!

I received an email that my Mario World watch face was rejected due to copyright.  However prior to my creating the watch face I looked into Nintendo's policy and as long as you are NOT making any type of profit (aka free of charge and not paid) off of using an image there should be no issues. These type of images are used all the time.

 

I did not copy any type of Nintendo related fonts it's simply a background. So could someone please explain why the app was rejected.

You just need to resubmit and provide proof of the license.
