Watchface publishing wrongly refused for trademark.

I wrote a watchface (https://gam.fitbit.com/gallery/clock/491b3e03-fbfb-46a1-a2ad-265609f57e3c) and it was refused publication with this reply:-

Dear Allan, Thank you for taking the time to contribute to the Fitbit
App Gallery with the Plok Time clock! We have reviewed your submission
and, unfortunately, due to the fact that the character Plok is a
trademark of Nintendo, we regretfully inform you that we have declined
your submission. Please consult the following link for more
information: https://dev.fitbit.com/legal/app-gallery-guidelines/
We hope this will not discourage you from creating and submitting
any ideas that you might have in the future. Kind regards, Fitbit Team

However, Nintendo don't own the "Plok" trademark, they did publish the original game on the SNES but the trademark actually belongs to the Pickford brothers (http://www.zee-3.com/pickfordbros/archive/plok.php).

 

I used to work for them and have checked they are ok with the watchface.

 

Do I need to do a rebuild/resubmit to get it approved?

Hey @allan175, sorry about that. Just resubmit and include some proof of the license for the review team. It should be fine. You can ask them to speak to me directly too.
