Sense freezes when charging

Some days ago I noticed that my sense went from 100% to 30% over night and it wouldn't sync with my phone. I had to reboot my sense and it worked again. When I a few days later changed my sense and when I removed it from it's charger, it wouldn't sync with the phone until reboot of the sense, and now last night the same thing, won't sync until a reboot. Whats can be wrong with my sense?

My sense is a week old and after I charged it for the first time, it no longer tracks my sleep.  Should I return it and get a new one, or go back to my charge 3.
