REFERENCE: Fitbit - Fitbit watch
I purchased a Fitbit watch from Fitbit. At the point of purchase I paid £129.99.
I bought a replacement Fitbit charge 5 in 22 apr 22 to replace a charge 3 which screen had become so dull I couldn’t read it. It is now July 2023 and the screen has gone completely blank for no reason! I have read through the Fitbit community to find a solution and there seems to have been a software issue and many people are complaining about this sudden issue. I have contacted Fitbit and have only given solutions which I already have done which were on Fitbit’s community site. This is the second Fitbit I have had and they do not last. I am so disappointed they nearly last a year and this is not satisfactory. Under consumer rights I am entitled to 6 years use I am just out of warranty and I should get the 5/6ths of the price back under the his law.
The Consumer Rights Act 2015 makes it an implied term of the contract I have with Fitbit that goods be as described, fit for purpose and of satisfactory quality.
As you are in breach of contract and I've owned the product between 6 months and 6 years, I am within my statutory rights to ask for it to be refunded. I await confirmation that you will provide the remedy set out above within 14 days of the date of this letter.
