I HAVE HAD FOR LESS THAN YEAR - NOT WORKING - IS IT STILL UNDER WARRANTY?

It should be - the warranty runs for 1 or 2 years from purchase depending on where you are in the world. There are some other conditions though (see the full terms via the link at the bottom of this page) so I suggest contacting customer support via contact.fitbit.com who can check your warranty status and advise on your options.
