Lemon or fixable?

I bought my inspire 3 11/26, since receiving I've had multiple issues. 

The heart rate monitor seems to constantly have a mind of its own (it just tracked me at 165 and I wasn't even wearing it), the battery doesn't seem to last long, settings seem to reset themselves (turned always on off, it was back on for a bit then went back off), data not syncing or showing incorrectly...

I'm not sure if these are glitches with fixes or if this one might be a lemon in need of replacement.

Hi @13X13 there is a firmware update recently released for the Inspire 3. Have you updated it?

Looks like the latest version. See what customer support says.

Update:

Support- ".: Our current version is 4.06" ".: If the update is not available in the store then you need to uninstall and reinstall the app."

I did so and contacted them again as nothing changed.

Support- ".: I can see on the system that your app is not up to date yet, please wait until tomorrow to check if the update is available or please try tomorrow to uninstall and install the app again, please keep the case number to continue assisting you with your case."

I asked if the new version be released in Google play tomorrow...

"Agent: Yes that is correct"
