I ended up over here through support as it seems this is the only way to attempt troubleshooting according to the emails I have received. Here is my situation:
I've restarted the device several times.
Behavior is the same on either firmware.
I've done 2 full resets on the device and gone through the setup fully.
I don't know what else it could be outside of hardware. This problem seems almost non-existent from my searching and I've requested a device swap, but they are having me start here.
If anyone can provide some additional troubleshooting tips I would appreciate it.

I would ask customer support to remove you from the developer preview, then see if the problem exists with the production firmware.

It existed with the initial production firmware, it's been like this right out of the box. I grabbed the beta to see if it would help.
But I'll do that and see if it makes a difference.
