During setup I'm being told device is locked? it's band new I just can not get past this!

If you haven't done so already, and in case your device is in Water Lock, please try to firmly double tap on the screen to unlock it. You can find more information about this feature here.
If the device is not in Water Lock and you continue to see this message during the set up process, I do recommend that you continue the communication with the Customer Support team for further assistance with this. It seems that you already have a case created and they've provided you with some instructions.
