Yes, you have the ability to post some data through the Web APIs. The documentation contains the endpoints for posting data to Fitbit. You will not violate our agreement. However, I would highly recommend that you include in your terms of service and privacy policy which fitbit data you are collecting and which data you are posting to their user's accounts.
Regarding the taxes, I don't know the answer. My recommendation is contact the person/distributor who sold you the devices.
