Charge 3 won't turn on

I ordered my Charge 3 online from Walmart and received it on 2/5/20. It was no longer working by early May. I reached out to Walmart who says that it was sold by a third party, third party says that warranty was only 30 days.

 

I replaced my Charge HR with this Fitbit because it was advertised as a Fitbit that I could swim in. I am out of my money as neither Walmart nor the third party will take responsibility. How do I get my money back or the Fitbit replaced? Please and thanks!
